מרקם ולמזרח ורקם כמזרח. ואפילו תימא חלוקין על ר"י שאין רקם כמזרח. שמא מבבל לכאן. רב אמר עשינו עצמינו כארץ ישראל לגיטין. ושמואל אמר אפילו משכונה לשכונה. בעא קומי מיחזור ביה. אמר ליה כהנא ומה נעשה לראשונות שנישאו. א"ל ומה בידך דהוא סבר כהדא דרבי דתני המביא גט ממדינת הים לא נכתב לפניו ולא נחתם לפניו תצא בשלשה עשר דבר דברי ר'. אבל חכמים לא הודו לדבר. הכל מודין שאם בא ועירר עררו בטל. עד כדון כשעירר משנישאת. עירר עד שלא נישאת ונישאת. נישמעינה מן הדא מעשה באחד שהביא את הגט לפני ר' ישמעאל א"ל מניין את אמר ליה מכפר סמיי שבתחום עכו. אמר ליה אף את צריך לומר בפני נכתב ובפני נחתם. ואל תזקק לעדים. וכשיצא אמר לו ר' אילעאי רבי והלא כפר סמיי מא"י היא קרובה לציפורין יותר מעכו. אמר ליה הואיל ויצא המעשה בהיתר יצא. מהו הואיל ויצא המעשה בהיתר יצא. אמר ר' זעירא שאם בא ועירר עררו בטל. אילו המביא מארץ ישראל לא"י שמא הוא צריך לומר בפני נכתב ובפני נחתם. הוי לא שנייה הוא עירר משנישאת הוא ערר עד שלא נישאת ונישאת. ר' יעקב בר אדא בר עתליי בשם ר' לעזר הלכה כרבי מאיר בגיטין. והוה ר' זעירא מסתכל ביה אמר ליה למה את מסתכל בי. דיתמר הלכה כמי שהוא מיקל בדברי סופרין. סברין מימר ביחיד אצל יחיד אבל ביחיד אצל חכמים לא. והכא אפילו יחיד אצל חכמים. ר' חייה ר' בא אמר

Any generation in which the Beis Hamikdosh is not rebuilt is considered as if they had destroyed it.

Rebbi Eleazar bar Yose asked before Rebbi Yose: Concerning what you say that one bill of divorce is invalid for two women24This refers to the last clause in the Mishnah, when the husband, married to two identically named women, orders a bill of divorce in their name without specifying to whom it will refer., should not two bills of divorce be invalid for two women? He asked him, what is the question? He answered, did we not state25Mishnah 9:5.: “If two people sent two [identical]26Added from the Geniza text. The same messenger carries two bills of divorce from two men, both called X ben Y, to two wives, both called Z bat U. bills of divorce which were intermingled26Added from the Geniza text. The same messenger carries two bills of divorce from two men, both called X ben Y, to two wives, both called Z bat U., he gives both documents to both women.” There, it is a divorce for this one and a divorce for the other one; the mix-up caused [the problem]27If each wife receives both bills it is certain that each one received the one intended for her.. But here, neither this one is divorced in her name nor is that one divorced in her name.

19This essentially is a text from Giṭṭin 9:8, Notes 105–115. Simeon bar Abba in the name of Rebbi Joḥanan: An empty space of two lines in a text about one subject in any case [invalidates]20Since text may be inserted in the document after the witnesses signed.. Rebbi Samuel bar Rav Isaac said: The Mishnah says so21Mishnah Giṭṭin 9:8, explained there Note 102.: “One Hebrew- and one Greek-writing witness …” Is not Hebrew combined with Greek one item? 22Tosephta Giṭṭin 7:11–12.“How far from the text should the witnesses sign? That they can be read with it23The signatures can be read with a text if the first signature be exactly one line away from the text., the words of Rebbi. Rebbi Simeon ben Eleazar says, one full line. Rebbi Dositheos ben Jehudah says, the width of the witnesses’ handwriting.” Rav Jeremiah said in the name of Rav: One estimates לך ולך24The line must accomodate letters extending both above and below the usual writing space; Babli 163a.. Rebbi Yasa in the name of Rebbi Sabbatai: the width of the witnesses’ handwriting.

“Give me the wheat, and the barley,” etc. Rebbi Joḥanan said, the words of Rebbi Jehudah imply collectively one sacrifice, in detail three sacrifices69This determines the anonymous author of the Mishnah who makes the liability for sacrifices dependent on the way the vow is formulated as R. Jehudah. This is confirmed in the Babli, 38a.. How is this? A detail wheat, a detail barley, a detail spelt. Collectively one sacrifice, in detail three sacrifices. Detail a third wheat, detail a third barley, detail a third spelt, are these taken together? Come and see; although he holds many details, even so they can be formulated collectively or in detail. In which respect? To make him liable for sacrifices. If he held four kinds, two kinds in one detail, two kinds on two details. even so they can be formulated collectively or in detail70Irrespective of the complication of the transaction, there always is a formulation of the oath which avoids mentioning any detail.. 71From here to the end of the Halakhah the text is from Giṭtin 9:7, Notes 85–101. The following paragraph describes efforts by two men to divorce their wives with one document to save on costs for scribe and parchment. As Rebbi Joḥanan said in the name of Rebbi Yannai: “And I am greeting X,” one can assume that he signed concerning everything; “I am greeting X,” he signed only for the greeting. Rebbi Simeon ben Laqish said, “I am greeting X,” one can assume that he signed concerning everything. What means “collectively”? Rebbi Joḥanan said, “X divorces Y and Z U.” What means “collectively”? Rebbi Simeon ben Laqish said, “We, X and Z, divorce our wives at place A.” Rebbi Ze`ira said, Rebbi Joḥanan agrees that if he mentions divorce for each one separately that he needs the typical text72While the Giṭtin text everywhere has טוֹפֶס “boilerplate document” which possibly is Accadic (from the Sumerian) ṭuppum “document”, the spelling here indicates Greek τύπος “figure, form” used as “prescribed form” (of the document.) and witnesses for each one separately. The strength of Rebbi Joḥanan is from the following: “ ‘That I shall not benefit from this one; a qorban for this one and a qorban for that one.’ Each single one needs a separate opening.73Mishnah Nedarim 9:7.” Rebbi Yose said, the Mishnah supports Rebbi Joḥanan: “If he wrote a separate text for each of them and the witnesses signed at the end, [only] the one with which the witnesses are read is valid.74Mishnah Giṭtin 9:7.
