Talmud for Sanhedrin 6:1

ורבי יהודה אומר בחמשה חליצה ומיאונין בשלשה נטע רבעי ומעשר שני שאין דמי ידועין בשלשה וההקדשות בשלשה וערכים המיטלטלין בשלשה רבי יהודה אומר אחד מהן כהן ובקרקעות תשעה וכהן ואדם כיוצא בהן דיני נפשות בעשרים ושלשה הרובע והנרבע בעשרים ושלשה שנאמר והרגת את האשה ואת הבהמה ואומר ואת הבהמה תהרוגו שור הנסקל בעשרים ושלשה שנאמר השור יסקל וגם בעליו יומת כמיתת הבעלים כן מיתת השור הארי הזאב והדוב והנמר והברדלס והנחש מיתתן בעשרים ושלשה ר' ליעזר אומר כל הקודם להורגן זכה ר' עקיבה אומר מיתתן בעשרים ושלשה:

But if the doubt exists, that the sight of the impurity dates partly from to-day and partly from the morrow, the impurity is certain, but the sacrifice uncertain. On account of this, R. Hiya bar-Joseph answered in the presence of B. Yohanan: Who is it who taught that one of these occasions of impurity can be divided into two? It was R. Yosse. He answered: You thus refute your own opinion; for you say that each twinkling of an eye of the time accomplished in a half-mile, according to R. Nehemiah, is doubtful, and not only the end of it. No contradiction can be offered to this; when the Prophet Elijah shall return to this world, and will explain to us what this twilight means, no one will contest him. R. Hanina argued against the disciples of the Rabbis: Since, said he, it is night as soon as three stars are visible, be the sun still high in the heavens, the same must apply (before the day) in the morning. R. Abba said: It is written (in Gen. xix. 23) : "The sun was risen upon the earth when Lot entered into Zoar;" and is written (in Lev. xxii. 7): "And when the sun is down he shall be clean." The sunrise is compared with the sunset: As sunset corresponds to the disappearance of the sun from the sight of man, so also sunrise is manifested by the appearance of the sun to the eye of man.

226A parallel in Sanhedrin 6:8 (fol. 23c, line 17). Similar arguments in the Babli, 8a, Sanhedrin 45a. The argument of Rebbi Jehudah seems inverted. There227Mishnah Sanhedrin 6:5, speaking about people executed by stoning. According to R. Jehudah, they are clothed in rectangular sheets of cloth., he says: “One covers a man in front and a woman front and back.228But the majority holds that a woman is stoned only fully clothed. Therefore, R. Jehudah seems unconcerned that men should get bad ideas in seeing her.” And here, he says so? There, she goes to her death anyhow, but here, maybe she will be found to be pure and the young priests would attack her229This is an explicit statement of R. Jehudah 1:7.. The argument of the rabbis seems inverted. There230Mishnah Sanhedrin 6:5, Soṭa 3:9., they say: “A man is stoned naked but no woman is stoned naked.” And here, they say so? There, “you shall love your neighbor as yourself,” choose for him the easiest death231Since in rabbinic tradition a person is “stoned” by being pushed down from a high cliff (Mishnah Sanhedrin 6:6), his chances of being killed instantly are greater if his fall is not cushioned by clothing. In the Babli, this is not considered a complete answer; the question is whether shame or suffering is worse.. But here, 232Ez. 23:48.“all women should be taught and not do as your whoring.”

Rebbi Ḥiyya said that Rebbi Yasa asked: We have stated227Mishnah 6:2.: “The herald goes before him: ‘X ben Y is led to be stoned because he committed crime Z; U and V testified against him. Anybody who knows of his innocence shall come and argue.’ ” We inferred that he who hears from one who heard has to rend. Does he who hears from one who heard from one who heard have to rend228Does everybody who hears the herald have to rend his garment? Since this is not mentioned in the Mishnah, the implied answer to the question is negative.?
